Terms of Service

These terms are an agreement between you and BT Vickers App Development Pty Ltd (ACN 699 645 184) (“we”, “us”), of West Perth, Western Australia. By using the Tink app or the tinkdate.com website you accept them. If you do not accept them, do not use Tink.

1. What Tink is

Tink helps two (or a few) people agree on a date plan: you connect phones, swipe on food and activity ideas, and receive suggestions of nearby venues, often with links to third-party booking services. Tink is a planning tool for people who already know each other — it is not a dating, matchmaking, or introduction service.

2. Who may use it

You must be at least 18 years old. Venue suggestions can include bars, breweries, and wineries; Tink is built for adults.

Using Tink requires signing in with an Apple or Google account you control. Your Tink identity is derived from that account, so keep it secure — anyone who can sign in with it can use your Tink identity. You can end things at any time via Settings → Delete my data (a step-by-step guide lives at tinkdate.com/delete-account).

4. How Tink is paid for

Tink is free to use. We may fund it in any lawful way, including affiliate commissions, advertising, sponsored or featured venues, paid placement, subscriptions, or commercial partnerships, and we may change how we do that at any time.

Suggestions are chosen using the information we hold about each venue — things like category, opening hours, ratings and availability — together with what you and your partner swiped. Commercial relationships may also be a factor in what we show you and in what order. Where we are paid to feature a venue, we will label it as required by law. Nothing here is a guarantee about which venues you will see.

You can report a partner from the chat in any session. Reporting preserves a snapshot of the recent chat — including the messages themselves — as evidence (see the Privacy Policy), and we review reports promptly. We may suspend or terminate access that breaches these terms — and deleting an account does not lift a suspension. 6. Chat

Chat exists between session participants only and is not monitored. It is deleted shortly after the session ends, with one exception: filing a safety report preserves a snapshot of the recent chat as evidence (see the Privacy Policy). You are responsible for what you send.

7. The service is provided “as is”

Tink is provided “as is” and “as available”, without warranties of any kind, express or implied, to the extent the law allows. We do not guarantee the service will be uninterrupted, error-free, or that any venue will be open, available, or as described. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of certain damages, so parts of this section and Section 8 may not apply to you.

8. Liability

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Otherwise, to the maximum extent permitted by law, we are not liable for indirect or consequential loss, and our total liability in connection with Tink is limited to AUD $50 or, where a law requires more, the amount that law requires. Your date going badly is, regrettably, outside our control.

9. Intellectual property

Tink, its branding, and its content (excluding venue data owned by third parties and your own messages) are ours. We grant you a personal, non-transferable licence to use the app on your Apple or Android device under the App Store or Google Play terms (as applicable).

10. App stores

If you downloaded Tink from the App Store: these terms are between you and us only — not with Apple Inc. Apple is not responsible for the app or its content and has no obligation to provide any maintenance, support, warranty, or to address any claim relating to the app (including product liability, legal compliance, or intellectual-property claims). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. You must comply with any applicable third-party terms (for example, your wireless data agreement) when using the app. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

If you downloaded Tink from Google Play: these terms are between you and us only — not with Google LLC. Google is not responsible for the app and provides no warranty or support for it.

11. Privacy

Our Privacy Policy explains what we collect and why, as things stand today. It forms part of these terms.

12. Changes and ending the service

Tink is under active development. We may change the app, how it works, what it costs, and how it is funded, and we may update these terms accordingly; material changes will be shown in the app before they apply to you. We may modify or discontinue the service — if we discontinue it entirely, your past date ideas remain on your device, and we will delete the server-side account data described in the Privacy Policy.

13. Governing law

These terms are governed by the laws of Western Australia, and disputes are subject to the non-exclusive jurisdiction of its courts.
